Uncontested timeline: approximately 3–6 months. Court filing fees are graduated by estate value under SCPA §2402 — confirm the current schedule with the court or your attorney. Attorney fees typically range $3,000–$10,000 depending on complexity.

Orange County Considerations

Orange County estates with real property in Warwick, Cornwall, or Monroe require deed-specific filings coordinated with the Surrogate’s decree. Small estates may qualify for simplified administration under SCPA Article 13 — no Surrogate petition required — but real property is generally excluded.

2026 NY estate tax: The exclusion is $7,350,000. Estates above $7,717,500 (the 105% cliff) lose the exclusion entirely. See tax.ny.gov for current rates.
